The Statutory Right to Dower & Personal Dowry Property

Under Islamic personal law and the West Pakistan Family Courts Act, 1964, a Muslim wife possesses absolute statutory ownership over her Dower (Haq Mehr) and her Dowry Articles (Jahez). Dower is not a bride price, but a mandatory financial consideration or asset settled upon the wife by the husband as an essential mark of respect and financial security under the marriage contract (Nikahnama).

Similarly, dowry articles—comprising furniture, household appliances, clothes, electronic goods, and bridal gold ornaments given by her parents or relatives at the time of marriage—remain her exclusive personal property. Neither the husband nor his family members hold any legal right or title to retain, sell, or damage these articles upon matrimonial separation.

When marital harmony breaks down, husbands or in-laws frequently refuse to deliver these assets. At Naich Law Firm, we initiate swift recovery suits in the Family Court to secure full physical possession or complete equivalent market monetary compensation.

Dower & Dowry Recovery FAQ

Prompt Dower (Haq Mehr Mu'ajjal) is payable immediately upon demand by the wife at the time of marriage or anytime thereafter during the subsistence of marriage. If the husband fails or refuses to pay prompt dower, the wife has the legal right under Islamic law to refuse conjugal relations until it is paid. Deferred Dower (Haq Mehr Mu'wajjal) is payable upon a specified future event, such as the dissolution of marriage by divorce/Khula or the death of either spouse.
